The Management Board of Energomontaż-Południe S.A. (Issuer) hereby announces that on 12th January 2010, the negotiations between the Issuer and Biuro Projektów "Koksoprojekt" Sp. z o.o. in Zabrze (Employer) concerning continuation of the agreement concluded by and between the Issuer and the Employer on 3rd September 2009 were ceased. Due to the lack of mutual understanding, the agreement in question shall not be continued. The party terminating the agreement, without specifying the reasons, is the Employer. The subject of the Agreement was delivery and installation of two facilities (a desorption apparatus and a catalytic decomposition system) under the investment performed by the Employer for which Employer is a general contractor consisting in construction of an installation for coke-oven gas purification fro ammonia and hydrogen sulphide including their environment-friendly and economically sound operation under a turn-key system for one of the domestic coking plants. The value of the Agreement in question was PLN 45.6 million. The parties are currently establishing the financial consequences of the agreement termination. The fact of having concluded the agreement in question was announced by the Issuer in current report no. 48/2009 of 4th September 2009.
